Terms of Service

The terms that govern your use of our store, website, and services.

These Terms of Service ("Terms") govern your access to and use of the Richmond Hill Wines website, online store, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Age Requirement

You must be at least 18 years of age (the legal drinking age in Alberta) to use our Services or purchase any product from us. By placing an order, you represent that you are of legal drinking age. Valid government-issued identification is required at the time of delivery, and we reserve the right to refuse delivery if the recipient cannot provide proof of age.

2. Account Registration

To place orders, you may need to create an account. You agree to provide accurate, current, and complete information, and to keep your password confidential. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect any unauthorized use.

3. Orders and Pricing

All orders are subject to acceptance and availability. We reserve the right to:

  • Limit quantities purchased per person, household, or order.
  • Refuse or cancel any order at our discretion, including orders that appear fraudulent or incorrectly priced.
  • Update prices, descriptions, and product availability at any time without notice.

All prices are in Canadian dollars (CAD) and exclude applicable taxes, which will be calculated at checkout. We make every effort to display accurate product information, but we do not warrant that product descriptions, vintages, or prices are always error-free.

4. Payment

Payment is processed at the time of order via our payment provider, Stripe. By providing payment information, you authorize us to charge the applicable amount to your selected payment method. If a payment fails, we may cancel your order.

5. Shipping and Delivery

Shipping is governed by our Shipping Policy. Risk of loss passes to you upon delivery to the address you provided. If delivery cannot be completed because no one of legal drinking age is available to sign for the package, additional fees may apply.

6. Returns and Refunds

Due to provincial regulations, alcohol sales are generally final. We will, however, replace or refund any bottle that arrives damaged or is found to be spoiled (corked, oxidized, etc.). Contact us within 7 days of delivery with a photograph of the affected bottle and we will make it right.

7. AI Sommelier and Recommendations

Our AI sommelier provides recommendations for entertainment and educational purposes. Tasting notes, pairings, and suggestions are informational and not guarantees of personal preference. We are not responsible for any decisions you make based on AI-generated content.

8. Intellectual Property

All content on our website — including text, images, logos, and software — is owned by Richmond Hill Wines or our licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or use any content without our written permission.

9. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in a manner that could harm or disable them.
  • Attempt to access accounts, systems, or data that you are not authorized to access.
  • Use automated tools to scrape, harvest, or extract data from our website without permission.
  • Resell products purchased from us without applicable licensing.

10. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, Richmond Hill Wines and its employees will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services. Our total liability for any claim will not exceed the amount you paid for the products giving rise to the claim.

12. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes will be resolved in the courts of Alberta.

13. Changes to These Terms

We may revise these Terms at any time. The most current version will always be posted at this URL, and changes take effect when posted. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
